Terms of Service

You must be at least 18 years old and capable of forming a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@garlicmax.ai of any unauthorized use.

You agree to use the Services in compliance with these Terms and all applicable laws. You may not:

• Use the Services to generate unlawful, harmful, or infringing content.
• Reverse engineer, resell, or circumvent usage limits or security controls.
• Interfere with or disrupt the integrity or performance of the Services.
• Use the Services to build a competing foundation-model inference product.

You retain all rights to the inputs you submit and, as between you and garlicmax, you own the outputs generated for you, subject to the rights of underlying model providers and applicable law. You are responsible for your inputs and outputs and for ensuring you have the necessary rights to use them.

Paid Services are billed based on usage and the plan you select at garlicmax.ai/pricing. Fees are stated exclusive of taxes. You authorize us to charge your payment method for all amounts due. Except as required by law, fees are non-refundable. We may change our prices with reasonable notice.

We strive to keep the Services available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue any part of the Services at any time. Service-level commitments, if any, are described in your applicable order form or enterprise agreement.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Model outputs may be inaccurate or incomplete, and you are responsible for evaluating their suitability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, garlicmax WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if required to protect the Services or other users. Upon termination, your right to use the Services ceases, and provisions that by their nature should survive will survive.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in San Francisco, California, unless otherwise required by applicable law.
